These terms apply to the Brainkrea website and all services provided by Brainkrea, including branding, graphic design, creative direction, web design and development, book design, file preparation, author services and publishing assistance.
Services and proposals
The specific scope, deliverables, schedule, revision limits and price for a project are defined in the applicable proposal, estimate, invoice or written agreement. Website descriptions and starting prices are informational and may not represent a final quote.
Brainkrea does not guarantee sales, rankings, reviews, audience growth, profitability or other commercial outcomes.
Client responsibilities
Clients must provide accurate information, timely feedback, required access and complete lawful materials. The client is responsible for reviewing names, text, links, dimensions, files and final deliverables before approval or publication.
Payments, changes and refunds
A deposit or full advance payment may be required before work begins. Work outside the approved scope, additional revisions, delays or new deliverables may require additional fees. Completed services, approved stages and delivered digital files are non-refundable. Other refund requests are assessed case by case.
Intellectual property
Clients retain ownership of materials they provide and confirm they own or are authorized to use them. Unless otherwise agreed, rights to final approved deliverables transfer after full payment. Brainkrea retains rights to preliminary concepts, rejected work, methods, tools and reusable know-how.
Brainkrea may display completed public work in its portfolio and marketing unless confidentiality or non-disclosure terms state otherwise.
Websites and third-party services
Clients are responsible for ongoing hosting, domain, plugin, platform, licensing and third-party subscription costs unless expressly included. Brainkrea is not responsible for outages, policy changes, security incidents or service termination caused by third-party platforms.
Book design and Amazon KDP
Book services may include layout, cover adjustments, file preparation and independent Amazon KDP assistance. The client must approve final files and remains responsible for content, metadata, tax information, payment accounts and compliance with platform rules.
All royalties belong to the client. Brainkrea does not collect or manage royalties. Amazon makes all final decisions regarding approval, distribution, suspension or removal. Brainkrea is not affiliated with or endorsed by Amazon or Kindle Direct Publishing.
Delays and approvals
Schedules depend on timely client materials, feedback and approvals. Brainkrea is not responsible for delays caused by incomplete submissions, third-party platforms, force majeure or client response times. Approval of a deliverable authorizes Brainkrea to proceed to the next stage.
Prohibited content
We may refuse or terminate projects involving illegal, fraudulent, hateful, defamatory, infringing or misleading content, or content prohibited by an applicable platform. The client assumes responsibility for claims arising from submitted materials.
Confidentiality
Each party will use reasonable care to protect confidential non-public information received during a project. This does not apply to information already public, independently developed or required to be disclosed by law.
Limitation of liability
To the maximum extent permitted by law, Brainkrea is not liable for indirect, incidental or consequential damages, lost profits, lost sales, data loss, third-party platform decisions or business interruption. Brainkrea’s total liability is limited to the amount paid for the specific service giving rise to the claim.
Termination
Either party may end a project in writing. The client remains responsible for work completed, committed costs and non-cancellable expenses through the termination date. Deliverables may be withheld until outstanding balances are paid.
